According to the European Guidelines 2003/86 and 2003/109 that regulate the rights of long - term residents from third countries, Austria has, from 1.1.2006, brought a new law, the "Niederlassungs- und Aufenthaltsgesetz" into force following the main cornerpoints of the mentioned guidelines.
According to this new law, an applicant has the right to receive a residence permit if he meets the following requirements:
The residence permit will be granted if the applicant meets all mentioned requirements and obtains a place in the yearly quota issued by the government. This quota limits the number of permits and starts new every year on the 1st of January. It is therefore highly recommended to file in in January as otherwise a quota place cannot be guaranteed. In cases where the applicant is not given a quota place, he has to file in again next year.
Once residence has been granted, it has to be renewed every year; after 5 years of residence the permit will be issued unlimited. To get this unlimited permit, it is necessary to prove sufficient knowledge of the German language. The law requires fulfillment of level A2 of the European reference guideline for languages, which includes 300 hours of teaching. This level will end with a short test executed by most language schools in Austria.
After 10 years of residence it is possible to apply for Austrian citizenship. For this, an easy exam as to language skills and Austrian constitution and history has to be passed.
